Who can make a petition
People or Boards with a specific interest can make a written petition to the Ombudsman in case they have already get in touch with provincial offices, boards or companies without obtaining any satisfying answer.
The Ombudsman of the Province of Milan is Mr. Marco Quiroz Vitale, Lawyer.
In which fields the Ombudsman can act
The Ombudsman can act at the provincial authority and at boards and companies depending on it in order to guarantee the regular progress of the administrative processes and to assure the correct and well-timed issuing of acts.
- He can go over acts dealing with the current matters.
- He can directly get in touch with the person in charge of the involved sector.
- He can act on his own initiative.
For facts under the competence of the Public Relation Offices, the Ombudsman can operate only after an unsatisfying or inexistent intervention by these offices.
Specific Intervention
The right of access to official documents ( Art. 25, paragraph 4 L. 241/90 modified text)
Article 25 of the law 241/90, modified and integrated by law 15/2005, at paragraph 4, provides that if the term of 30 days have expired without obtaining a response from the date of request to seek access to official documents, it must be understood that the request has been rejected.
If access has been refused, whether expressely or tacitly or it has been deferred, the citizen making the complaint can present an appeal to the ‘Tribunale Amministrativo Regionale’ (Regional Administrative Appeals Tribunal) within 30 days whereby requesting the Administration within the same period through the Ombudsman requesting a reappraisal of the decision.
If the position of the Ombudsperson does not exist within the local authority in question, the citizen must refer to the Ombudsperson with jurisdiction which is immediately hierachichally superior on the territory.
The Ombudsman will decide within 30 days from the review presentation date.
If the 30 day period expires without a response, the appeal is considered as having been refused.
If the Omsbudsperson considers illegitimate the denial or the delay unjustified, he will inform the citizen and will communicate it to the parties concerned.
If they do not issue a justified confirmation of the refusal within 30 days from receiving the request from the Ombudsperson, then access is authorised.
If the request of access has been made to the Ombudsperson, the 30 day period starts from the date on which the citizen receives the Ombusperson’s reply to his or her appeal.

In which fields he cannot act
- On acts or procedures which are related to petitions submitted to the administrative, civil or tributary justice authorities, or which the penal judicial authority is responsible for.
- On the application of union agreements dealing with employees.
Intervention modalities
The Ombudsman writes down his own opinion on the base of collected information, investigations and personal initiatives, and finally submits his advice to the involved applicants.
He can orally express his opinion in case of incompetence.
He points out transgressions, malfunctions or evident anomalies to the competent Boards, Offices and Services, urging them to act.
